former officers. what i see here is no interpersonal communication at all. i see no immediacy of threat that was posed to the officers such that they would respond. i see no proportionality with respect to the force and the hitting, punching, kicking, using everything that they used. you have a duty to act, to intervene and that did not happen and that is problematic, that is troubling, that is criminal. what is being charged here is a second degree murder charge which requires officers to show beyond a reasonable doubt as to each of those individuals individually, a knowing killing. taking action under the impression they should have known that it was likely to result in death. there are other lesser charges here, which could be the ultimate outcome, but i think all things considered, i think the prosecutors charged this case appropriately. still ahead this hour, jerusalem is rattled by a pair of shooting attacks just hours apart. israeli authorities are responding to the violence
more charges. so it s very possible there could be an upgate and the emts have been reprimanded for their conduct with respect to the death of mr. nichols. all five facing the same charges including the second degree murder charge. i guess that s significant given in tennessee that means one knowingly killed another person. what do you think what does this say to you that all five of these people have the same set of charges? all five were active participants. other situations there are four or five officers on scene but
other hand, you have to demonstrate that it was a knowing killing as you heard the prosecutor say. what does that mean? it means you have to appreciate and know that the nature of your conduct could cause a death, and so the prosecution will argue that you can t tell me in looking at the video, the prosecution i m sure will say, as a result of your conduct that you cannot appreciate that someone might die as a result. very important, right? now you look to the punishment. first degree is life, or life without parole. second degree murder charge, you re looking at 15 to 60 years under the tennessee statutes and then of course, as the prosecutor spoke to the other charges relating to the not only assault, but the aggravated nature, the prosecutor himself saying, hey. you know what that means. we can all anticipate that what we re going to see is pretty grim on the video, and of course, when it talks to the issue of kidnapping, yes, officers may stop and detain you, don, sara, under the a
terminated. i think it says a lot about her and the stance she s taking. i think she must talk to the men and women and let them know this has to make us better and our community better. aretha, what did you make of this, it s the first time we heard in the press conference, that there was a lapse in time from when police called for medical help? how do you see that factoring into the charges, particularly the second degree murder charge, knowingly killing somebody? what do you see? i m concerned about that as well, pamela. don did an interview with the district attorney before the press conference and ask if there would be charges called against the first responders and the district attorney said this investigation is ongoing. he wouldn t commit to whether there would be charges. i wouldn t be surprised if we saw additional charges brought against the emt workers. it plays into this notion that
