The court has decided to take up this key civil rights case whether gay rights is a right under the constitution. The the Court Earlier decided not to take up the case but then they were forced really to take up this issue. In november the sixth circuit ruled there was no right against gay marriage. So its up to the Supreme Court to resolve it. Theyll take up this issue involving four different states. Michigan kentucky, ohio, tennessee, all those states ban gay marriage. The courts have waded into this a bit in the past. They did throw out a part of the federal acts that prohibited the federal government of recognizing guy marriage saying they did have to recognize gay marriage approved by the state.
