Amazon Hit With ADA Suit After Medical Pot Patient s Firing
Law360 (March 12, 2021, 2:00 PM EST) Amazon Logistics Inc. has been sued by a prospective delivery driver who alleged that the company rescinded a job offer during training after his positive marijuana test, despite assurances that his medical marijuana treatment would not affect his hire.
David Bisacca said in Thursday s complaint that Amazon and Pennsylvania-based JMP Logistics Inc. violated the Americans with Disabilities Act, and that they denied him reasonable accommodations for his post-traumatic stress disorder symptoms. Plaintiff was: point-blank discriminated against for his actual or perceived disabilities; not accommodated; and/or discriminated against for having a lawful medical marijuana certification issued by the commonwealth of Pennsylvania, Bisacca.
