cell towers from time to time to see if you have any new text messages or e-mails so that it s leaving this trail that can be accessed by the police. danny, as the law stands right now, who has access to data from a person s private mobile phone? in 2014, the supreme court ruled that police need a warrant to search the information contained on your device. that s not the case. in fact, this case isn t even about your phone calls, the contact of your phone calls or the content of your text messages. this is about noncontent information. as we just heard, when your phone is searching around for local cell phone towers to ping off of, this is really, it boils down to an inference that s drawn by law enforcement based on data not about what s in your phone but data about where you are located. and that s where this battle comes down to. on the one hand, the government has it s the heavy favorite.
move. who should have access to that data? what about law enforcement? should it require a warrant? sure, it s about the changing scope of the fourth amendment in a digital age but a case before the supreme court tomorrow could go far to change privacy expectations for all of us whose smart phone is like a third hand. nbc s justice correspondent pete williams joins me now with more on that. and danny cevellao, msnbc legal analyst, is also here. pete, walk us through how we got here. what was the impetus of the case? it was the fbi gathering cell phone data to try to solve a string of burglaries in the detroit area, people stealing cell phones ironically from radio shack and t mobile. the fact is when you use your cell phone, this is not about data stored in the phone, this is about data stored by the phone company. but every time you use your phone, as you move around, it connects to a different cell tower, and the phone company keeps records.
