Judge Daniel O’Hanlon issued the warrant to hold for no later than Monday, May 17, at the request of Crown Prosecutor Oryn Holm. This means that MacKay, or his lawyer, must appear by Monday or the warrant will be activated and MacKay will be arrested. He was released on bail after a show cause hearing in Battleford Court of Queen’s Bench in April.

Beaven waived Heathen’s attendance in court today but she is expected to appear by CCTV on April 19. Heathen has been incarcerated at Pine Grove Correctional Centre for women in Prince Albert since her arrest in July 2020. Heathen is charged with second-degree murder in the death of Braeden Alfred James Sparvier, 26. Twobears Bird, 22, of Onion Lake Cree Nation, was arrested in February 2021 and charged with accessory to murder. The charges against Heathen and Bird haven’t been proven in court.
Lawyer Brian Pfefferle, who represents Bear, told the court that he is in discussions with the Crown, adding that, “further disclosure is forthcoming.” Pfefferle said he has sufficient disclosure to enter an election how Bear wants to be tried but requested a one-month adjournment. Likewise, lawyer Kathy Hodgson-Smith, who represents Dillon, said she has received disclosure, is reviewing it and needs one more adjournment. Disclosure consists of the Crown’s case against the accused and usually includes search warrants, the charging document, details of the offence, audio/video and transcribed witness statements, statements from the accused, expert reports, exhibits, private communication intercept authorizations, evidence, and criminal records of witnesses and the accused.
