Mr McClean (54) was shot multiple times as he sat in a parked car on the Cliftonville Road in north Belfast last week.
Originally from Andersonstown in west Belfast, he was due to go on trial later this year on four terror-related charges. The charges against him were formally quashed at Belfast Crown Court on Wednesday.
The father-of-two, who was killed by a lone gunman, was identified as a dissident republican in court in 2019.
His murder has been linked to a fall-out among dissident republicans.
A 32-year-old man was arrested in connection with the killing on Wednesday, while two men aged 46 and 38, arrested in north Belfast on February 2, were released unconditionally on Monday.

The PSNI said the murder of Daniel Danny McClean in North Belfast last week remains in a very active phase as they appealed for members of the public to come forward with information.
Police have been granted an additional 48 hours to question two men arrested as part of the investigation into the murder of Daniel Danny McClean in Belfast.
The two men, aged 46 and 39, were detained in the city on Friday and taken to Musgrave PSNI Station for questioning.
Danny McClean was shot multiple times while sitting in a parked car in the driveway of a guesthouse on the Cliftonville Road in north Belfast earlier this week.
The shooting was reported to police shortly after 8pm and McClean, aged 54, was pronounced dead at the scene.
He had links to dissident republican group ONH (Oglaigh na hEireann) and previously served in the British Army. McClean was expelled from the gang two years ago amid informant allegations. He was on bail facing arms charges and staying in a nearby bail hostel at the time of his murder.
