California man sues after father dies during taco eating contest

© Thinkstock A California man has filed a lawsuit against the organizers of a minor league baseball game after his father choked to death during a taco eating contest at the event, The Associated Press reported Monday. Eighteen-year-old Marshall Hutchings filed the negligence suit on Monday, almost two years after his father, Dana Hutchings, died on Aug. 13, 2019, at the Fresno Grizzlies game. Marshall Hutchings alleged his father was not given warning about the potential dangers of participating in the contest, which involved eating as many tacos as possible during a set time. ADVERTISEMENT The contest was the first of its kind that Dana Hutchings had ever participated in, the Fresno Bee reported. He was 41 at the time of his death.

Hutchings son, 18-year-old Marshall Hutchings, says his father was not made aware of the risks and danger involved in the eating competition, reported the Fresno Bee. Marshall filed the 8-page wrongful death lawsuit on Monday, April 5, which alleges that Fresno Sports and Events, which owns the Fresno Grizzlies, did not have the experience or competence to safely carry out an eating competition. Hutchings attorney AP News, professionals in competitive eating contests normally train and physically prepare themselves to participate. But that is not always present in an amateur eating contest,” Taleisnik said. “The conductors of this event should have made the risks known to the competitors and taken steps to protect them.”

Chuckchansi Park is where the Grizzlies play and apparently this event was apart of the activities for that days game. The family of Hutchings is telling media that they were not informed of the risks and dangers of taking part in the contest and are suing the Grizzlies and Fresno events and sports for in undisclosed amount. Man, horrible story and a horrible way to have to leave your family. If the Grizzlies did not have the contestants sign waivers stating that there were dangers to participating in the event, they are for sure going to have to pay this family out!!
