David Owen, the South Dakota Chamber of Commerce and Industry president and chief lobbyist, spoke to the Dakota Valley Business Council Dec. 1 about the 2021 legislative season and what happened in the last election. In the November 2020 election, three ballot measures were voted in by residents of South Dakota – legalize recreational marijuana (Constitutional Amendment A), medical marijuana (Initiated Measure 26) and sports wagering in Deadwood (Constitutional Amendment B). Owen expects that Amendment A will be the hot topic during the upcoming legislative season. The law won’t go into effect until July 1. Since Amendment A was a constitutional measure, it can’t be altered. A group is challenging the amendment as it’s supposed to be based on one topic and there were sentences relating to medical marijuana and hemp. The Attorney General’s office has said the amendment is okay.
