butch casey s burned-out mercedes. the tracks were left by a getaway car, which the state said matched seth penalver s oldsmobile. you know, it was damning evidence. and it was evidence that on top of everything else, it probably hurt us. finally, the prosecution called their witnesses against seth, including kimberly sam, one of seth s former roommates. kim sam, she and seth were living together at a house in sunrise, florida. she said seth had come to the house with pablo aybar, a black mercedes, came in, had blood all over his clothes. he and pablo took their clothes off, washed them in a washing machine, red bubbles had come out of the washing machine. and she said she saw him with aybar, changing clothes, taking a shower, and driving off in the mercedes. kim says, i come home, see bloody bubbles flying out of the washing machine. but crime scene technicians went
that was pablo aybar. i m saying, this is great. this is the guy. gary foye, butch casey s neighbor, came in and positively i.d. d aybar as the man he saw driving the mercedes the morning of the murder. he doesn t pick alex hernandez as the passenger, he says he looks pretty similar, but he does pick aybar, he says, i m sure that was the driver. aybar seemed a good match for the moustached killer. and he soon got a second id from his roommate, john clemesco. were you sure right away that was pablo on that tape? yeah. clemesco also claimed to recognize the other man on the video as someone named pimp lover. police determined clemesco was referring to 21-year-old seth penalver from ft. lauderdale, florida. they traveled with the same morning of friends, and on the morning of the murders he said
the detective paul manzella denied it under oath twice in front of a jury. and john clemenco, i asked, did you ever get a reward, no. no. no. i called paul manzella to the stand and i put those documents in front ofim. i said did you pay a crimestoppers tip? it s your handwriting. it s your notes. and he says yeah. so when that testimony finished watt jury realized is that paul manzella and john clemesco were prepared to swear under oath to something they were lying about in order to have seth panelva convicted. our theory at trial obviously was it was aybar and either rincon or hernandez. why not? they were his buds. couldn t they be the image just
