and that deals with the estate tax break, it doesn t go to current law. if you go with current law, you would have especially, $68 billion, that is going to cost taxpayers over currents law for 39,000 states and we had a better compromise instead of the deal cut, that provides 25 billion dollars, to 6600 families and it s doesn t help the economy and hurts the deficit and though the republicans do not insist on the estate tax being part of the central portion of here s the question, be the, let s get to a little, quick if it passes in the senate and everybody expects that it will, will there be an up-or-down vote on the entire package? there will be an opportunity for the house to work its will. what the form the bill takes, as it comes to the floor is something that will be decided. people are looking at various alternatives and the main sticking point for most people,
you are campaigning every day, and, appreciate your time, and why does florida need this law? well, right now, florida has a lot of problems with drug trafficking coming in with illegals bringing drugs into our state from the west and, quite frankly, this law does several things, one, it takes a provision of the arizona immigration law, something similar to it, and, says when a police officer stops, detains or arrests somebody and they have reasonable suspicion the person is an illegal immigrant, for example not having a drivers license or not one that looks like it is real, they have the mandate, in the proposal, to find out and check and now they have the authority your law says they can check whether or not they are legal, right. currents law is permissive, this law would mandate it. and, in addition, what we have done in this bill is to enhance the penalties, if you are arrested for a crime, one of drug trafficking or grand theft, because you are also an illegal
the federal law and federal policy that exists, in the primary area of immigration law, i spent many years on the immigration committee in the u.s. congress and i understand these laws, that are there and this is simply giving our law informant clear advice, clear direction, and what they should do, providing judges with the power to consider in the issuing bonds, the fact that somebody might in an illegal which is now questionable and, there are a number of things that enhance the powers of our local police should they wish to use it. and mandates when they are stopped for another crime, there is reasonable suspicion there s an illegal and they have to check with immigration service and find out if they are or not, and they should be doing that today but they aren t, necessarily. bill: thank you for your time, bill mccollum, we ll see how it work out. patti ann: wait until you see this, a wild ride lands a car inside a house and the driver
immigrants in our state, you are you have a higher, greater sentence. bill: on the judicial side it is tougher, as well and you know what happened in arizona, they struck down a lot of the measures and did not survive why will it survive in florida, do you think? well, first of all, we have changed the provide visiting to comply with the judge s criticism of the arizona bill and, secondly i m one of the attorney generals along with michigan and others that are defending the law in arizona against the constitutional challenge. and i don t think it stands up on appeal and seems the basis of that, the foreign affairs powers of the president does not wash, and these are enforcement of domestic laws and the enumerated powers of the constitution do not give the federal government general police power and left those to the state and i think we win that eventually like we ll win the lawsuit i have out now to have obama s bill declared unconstitutional, and for similar reasons. bill: we ll
discussion and in virginia they crafted the language in the law that says you may ask about citizenship and not that you should or can. and, virginia argues that that will pass legal muster, unlike what happened in arizona, and, i think that they d disagree with what you are suggesting as to whether or not it would stand in front of a judge. this it s not an inquiry issue, the question of whether or not they make a phone call to the immigration service and ask them the way the police have a right to ask, mandates they pull the trigger each time and make the phone call into the immigration service, i am asked that is you are in a tough race and you have a primary in 12 days and rick scott is a republican and every poll i look at seems to average out between 6 and 8-point leads of scott over you and is it politics you are trying to pull here. this is talked about a lot and we have a close race and no, it s not politics, it is
