jean is outside the courthouse. what do we know about the new charges? are they new accusers? they were just announced that we have not gotten ahold of the indictment yet. it has been sealed and it is not available yet in the clerk s office. here s what we know. the grand jury did return an indictment on two more charges of predatory sexual assault. the prosecutors said this morning, your honor, if you believe that these two new charges of predatory sexual assault are duplicative, because we already have two charges, we can consolidate. the earlier ones can be dismissed. so now the charges are predatory sexual assault, four counts currently, criminal sexual act in the first degree, first degree rape, and third degree rape. now, one other thing. the prosecutors have wanted an additional witness to testify against harvey weinstein for months now. cnn has confirmed that it is the actress from the sopranos.
police department a few miles away. thank you for that reporting. disgraced movie mogul harvey weinstein due back in court. he s facing a new indictment returned by grand jury on something not publicly disclosed. cnn s jean casarez live outside of the courthouse in manhattan. what do we expect, jean. today is the arraignment on that indictment. it was returned by the grand jury, we believe, last week. we don t know what it includes. it s sealed. it could be new charges. we don t know that it is new charges, or it could be a clarification of existing charges. that does happen. currently harvey weinstein is charged with two counts of predatory sexual assault, a criminal sexual act in the first degree and two counts of rape. first degree rape and third degree rape. here is what we do know. for months prosecutors have wanted an additional witness to testify against harvey weinstein
will he dismiss the charges against harvey weinstein? they all say that would be very much of a legal long shot here. weinstein facing five criminal charges, including two counts of predatory sexual assault, one count of criminal sexual act in the first degree, one count of first degree rape and one count of third degree rape. the defense is looking to have all of these charges dropped. they say they have evidence which shows that the sex was consensual. what type of evidence? they say they have e-mails which show friendly correspondence between weinstein and these two accusers after the alleged incidents took place. they want all of these charges dropped. what could the judge do out here later on today? a number of different things. one, dismiss all the charges, which again look to be a legal long shot. he could set a court date, which is what the prosecution wants or he could do something in the
judge correctly decided it s too soon to get into that argument. the grand jury just makes a decision about whether the case will go forward and that kind of exculpatory evidence or at least what weinstein is claiming is exculpatory evidence like e-mails should be something a jury should see and decide. let s take a look at the charges as weinstein heads to trial, predatory sexual assault two counts, criminal sexual act in the first degree one count, rape in the first degree one count, rape in the third degree one count, maximum time that he could face under these charges should he be found guilty? a lifetime in prison, and that s why it s appropriate for him to have a vigorous defense. what i think is so interesting, craig, is the role that this trove of e-mails may play at trial. weinstein s lawyers claim that the evidence of friendly e-mails between harvey weinstein and women who now claim that he assaulted them is exculpatory, means he must be innocent, but the d.a. is saying t
