Oregon AG calls on lawmakers to address non-unanimous juries in wake of SCOTUS rulings

Alan Sylvestre Originally published on May 19, 2021 1:50 pm Hours after the U.S. Supreme Court ruled it wouldn’t overturn old non-unanimous jury verdicts in Oregon and Louisiana, state Attorney General Ellen Rosenblum asked lawmakers to hold hearings and pass legislation that would address hundreds of old convictions now considered unconstitutional. “There are hundreds of adults in custody in Oregon prisons who may have been convicted on at least one count by a non-unanimous jury,” Rosenblum said in a statement Monday evening. “I am calling on the legislature to, as soon as possible, convene an informational hearing to discuss how the legislature can assist in the expeditious resolution of these cases.”

Supreme Court Leaves Decision to Reconsider Past Spilt-Jury Convictions in State s Hands

Ramos v. Louisiana that criminal convictions made by a non-unanimous jury (when only 10 out of 12 jurors are in agreement on a verdict) were unconstitutional, promptly barring the practice from being used in the only remaining state that allowed for non-unanimous verdicts: Oregon. While the Ramos case came out of Louisiana, the state of Louisiana voted to bar non-unanimous juries in 2018, while the case was still moving through the courts.

Advocates to keep fighting non-unanimous jury convictions

(AP) Advocates for over 200 people found guilty of crimes by Oregon juries that weren’t unanimous said Monday that they will keep fighting to have the convictions vacated after the U.S. Supreme Court ruled that those people don’t need to be retried. The high court made that decision Monday after barring convictions by non-unanimous juries a year ago. Oregon and Louisiana were the only two states that had allowed such convictions. Now, juries everywhere must vote unanimously to convict. The high court s 2020 decision affected defendants who were still appealing their convictions but not those who had exhausted their appeals.
