agreement. that s what happens on capitol hill. there are always discussions and attempts at negotiations and that s part of what the department of justice would take into account in deciding whether criminal contempt charges are justified, whether criminal contempt charges are justified. and so, you know, it s very much a part of the strategy to show, hey, we have been engaged in negotiations. we have tried. we even showed up publicly, even though technically this is a violation of the subpoena not to agree to the house s terms, we tried and that will go into the decision that doj has to make whether to bring criminal contempt charges. i think the larger question is who s going to make that decision at doj and does merrick garland feel that he has to appoint a special counsel. we would have yet one more special counsel to make that determination. we ll see if it even gets to that because it does require at least a simple majority from the full house to advance it to the department o
precedent, to make the determination, if they can and should indictment. if we just wash this under the rug and say for the sake of the country, let s put this aside, there is going to be somebody else, whether it is donald trump in 2024, or somebody else somewhere down the line that recognized that as the floor of their behavior and pushed even more and we can t survive that. that was congressman kinzinger last hour on morning joe. now let s bring in capitol hill correspondent ali vitali. thanks for being with us. how likely is the committee to seen guinea thomas and what is the latest we just heard from adam kinzinger. reporter: in the same way that congressman is here as not a lawyer, i am too. but what i can tell you, it doesn t even matter that the committee refers or doesn t refer criminal contempt charges to the doj. the doj can do their own investigation. which is why we re seeing sort of this two-pronged pressure campaign from the committee. toying with the idea as they
who s facing criminal contempt charges in the steve bannon trial in washington, which started today, we re expected opening statements, tomorrow. and then, you know, blink and you might miss it, we expected to be fairly quickly after opening statements. prosecutors have said in the statement just thinking they re only gonna need one day to lay out their whole case against him. we don t know how long bannon s defense will take, but the judge has already told bannon s defense lawyers and pre trial hearings that he doesn t have much of defense to mount. but he is going to trial, and he will be trying for an acquittal, if he is convicted, he will be facing a year in jail, like in opening statements tomorrow and what is expected to be a fast trial of steve bannon in washington. so, we are seeing prosecution of individual defendants who took part in physically attacking the capitol. we are seeing this a couple of prosecutions for contempt of congress, people not participating, not following
