i was walking through the chow hall in prison, and somebody said, tom, i saw you on the news. i said, what for? they gave you a new trial. i said what? reporter: news of a new trial didn t change the minds of dar s family. they remained convinced, not only did tom kill dar, he did so on the day of his son s 10th birthday celebration. you think tom is cold blooded enough to do something like that to his kid ? yes. yes. i think there s evil in him. reporter: the prosecutor agreed. who killed dar foley? tom foley. there is nobody else. reporter: a year and a half after tom foley s conviction, both sides filed back into the courthouse to once again determine tom s fate. circuit court is in session. reporter: as before, the state opened its case with the crime scene analysts. what is it you found in the
speak for that person, you know, most crimes you have the ability to talk to a to the victim and ask them what happened and they can explain it to them and show them photographs. we don t have that luxury in homicide. down at the lab, some of the crime scene analysts were working on the tape used to bind the victims. there was a lot of tape involved in this case. we are looking at many, many hours if not a couple of days for dave to complete his processing on this evidence. specifically, on the tape, we were hoping to find the killer s fingerprints. there are two different patterns. we have a loop pattern and a small whirl pattern. anything involved in a wrapping of the tape around the ankles or ankles or face, that would be the person to wrap the tape on the victim. we got our second big break about 2:00 or 3:00 in the morning one night.
