and me, we have elise jordan and also charlie sykes and also chuck rosenberg. and as we were just mentioning, as he awaiting possible charges in georgia, which could happen this week, trump is already testing the limits of a new protective order put in place in the federal election interference case against him of course playing out in washington, d.c. and in court on friday, judge chutkan ruled that going forward trump s lawyers must review any notes he takes to make sure that he is not copying down personal information about witnesses. she also prohibited him from having a phone out while reviewing the materials for the same reason. and prosecutors requested this order after trump started
team trump said she said trump saying they were violating his rights. late last night judge chutkan said she will set a hearing on the issue. you guys can both argue your sides, and she said you know what, give me some dates this week. let s do this now. this week for hearing. and so jack smith his team said we are available this afternoon, thursday, friday. and before i tell you, just take a second to guess. into your guesses in about what the ex president s lawyers wanted. they said, how about next week? that s right. trump s team requested a hearing on monday or tuesday to allow both of his attorneys to appear. they did say they could make thursday work if needed, but they would prefer a next week, and interestingly, and without adding a any explanation they wrote that, quote, we lost friday as an option. well, judge chutkan, just a little while ago rejected team trump s proposals to delay the hearing.
the case in the media rather than the courtroom. the ex president trying to stall his criminal trial has a different take. crooked joe now wants the thug prosecutor, this deranged guy, to file a court order taking away my first amendment rights so that i can t speak. we don t want you to speak about the case. i will talk about it. i will. they re not taking away my first amendment. [applause] that s false, to be clear. a protective order is not a gag order. it s routine. it will be the subject of friday s court hearing, whatever donald trump is saying in the microphones. of course this got started on friday. that s the day after trump appeared in federal court in washington, d.c., and pleaded not guilty to four felony counts. when trump posted a threatening message on social media that, quote, if you go after me i m coming after you. within hours of that obvious explicit threat, jack smith asked d.c. district judge tanya chutkan for a protective order.
she doesn t seem to care that trump s team lost friday as an option. friday has now been found. both parties will be required to be in court on friday. trump doesn t have to appear. of course, look, at some level, it s a small scheduling thing. this happens tens of thousands of times a day, probably, around america. but it illustrates so much about this case. not just about the case, where we are, the broader question, the fundamental question before the country. first of all, everyone, and i mean everyone, knows and understands the situation here. the judge does, the special counsel, trump s lawyers, trump, you, me, everyone watching. he wants to delay the trial. he wants to delay the trial long enough so that he can be elected president soaking it into the white house and escape accountability for his flagrant, and, in my mind, in the mind of special counsel, criminal attempt to destroy america s constitutional republic and
a young racist in atlanta. this is a person that wants to indict me. she has a lot of problems, but she wants to indict me to try to run for some other office. obviously, the district attorney knows this is the kind of stuff the former president says about her. she s faced a number of threats and her view is to shake this off, as long as what the former president is saying doesn t rise to the level of a threat against her, her staff or family. sara murray in washington, thank you. the judge who has been adined to preside over trump s election fraud case in washington, d.c. is ordering trump s attorneys to appear in court on friday. prosecutors say they are ready to dpo. trump s lawyers is asking for a postponement until early next week. joining us is former prosecutor jennifer rogers is with us. i want to start on this memo. it s the january 6th committee did not have this.
