Pet Theory: Judge Says Dog May Be Livestock In Zoning Fight
Law360 (January 15, 2021, 8:38 PM EST) A Massachusetts state court judge suggested Friday that puppies could fall under the definition of livestock as he heard closing arguments in a bench trial over whether a million-dollar bernedoodle operation can run in a residential neighborhood.
Kimberly Clinton, the owner of Massachusetts Bernedoodles LLC, sued the town of Ashby to appeal a zoning board decision that would prohibit her dog-breeding business on the 6.2-acre property. Clinton argued she falls under the Dover Amendment, a state law exempting agricultural corporations from certain zoning restrictions, and that her puppies are livestock.
