Weve been through a number of stages by now. The first year we really just shut down the courtroom and we did oral arguments in the way that i know many courts did. Did remotely. In our case, we did not do it by zoom, you cannot see our faces, we did it telephonically. We all got sophisticated telephone equipment to put in our houses and we did arguments from there. Of course there are nine of us. Generally we have a very freeflowing argument where everybody interrupt her everybody interrupts everybody else. Both the lawyers on the judges. We cannot figure out how that would work. We thought it couldnt work when we couldnt see each other and when we werent in the same building or in the same room. So, instead, we just used a system where each of us got a few minutes, sometimes it was three, sometimes it was for, sometimes
Then we decided we could go back to the courtroom. Is this working . It seems to be going in and out. Can we make it so it doesnt go in and out . Judge murguia a police they are working on that. Hopefully they are working on that. I would follow that directive. Justice kagan so we went back to the courtroom and did not open it to the public. We did open it to the press. People with press credentials. The Supreme Court courtroom was filled with the press and our clerks and that was kind of the audience. The question was, how should we go back to the old way of arguing cases and we were very split on that. I hope this isnt giving away secrets. Dont tell anybody if it is. Some people really like the new method we had developed. The one by one method. I think because it was more orderly. Less interrupting and less of a freeforall. The lawyers had more of a chance to speak and get the arguments across. And also, i think all of us liked the fact that Justice Thomas was a very active artistic
