Wastewater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Sevier County Open Cut Mining Operation Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“DEQ”) and Cossatot Rock, LLC (“Cossatot“) entered into a January 21st Consent Administrative Order (“CAO”) addressing alleged violations of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See LIS No. 21-010. The CAO provides that Cossatot operates an open cut mining operation (“Facility”) in Sevier County, Arkansas. The Facility is stated to have authorization to discharge sand and gravel wash water and stormwater runoff to an unnamed tributary that eventually flows to Milwood Lake. The Facility is regulated pursuant to an NPDES permit. The NPDES permit is stated to have been issued to Cossatot on June 23, 2015, and expired on June 30, 2020.
