On Monday, the Minnesota Court of Appeals ordered a Rochester man s conviction for first-degree criminal sexual conduct be vacated after finding that the charge arose from a single event, for which he had been convicted of another charge.
The appeals court did not rule on whether there was sufficient evidence for the man to be found guilty of the charge. The ruling also left the jury’s guilty finding in place.
In September 2019, Corey Lemond Bingham, 37, was found guilty by a jury of two counts first-degree criminal sexual conduct and felony fifth-degree controlled substance possession.
