(WKBW) — Supreme Court Judge Paul Wojtaszek issued a temporary restraining order saying the State Liquor Authority must give Santora s, Papi Grande and Prescott Provisions their liquor licenses back. These restaurants are part of the group of more than 90 that have sued the state to reopen indoor dining. On December 31, the owner of Santora s Pizza Pub and Grill, Paul Santora, appeared on Fox and Friends with attorneys from HoganWillig to discuss the lawsuit against the state. Hours later, the State Liquor Authority stripped Santoras of their liquor license, saying they did not have proper ventilation on their patio.

More than 90 restaurants in the Buffalo area have won the first round in a legal challenge to Gov. Andrew Cuomo’s “orange zone” dining restrictions. State Supreme Court Justice Henry J. Nowak today granted the restaurants an injunction lifting the orange zone ban on indoor dining that took effect in Erie County in late November, the Buffalo News reported. The restaurants had argued the indoor dining ban was unfair, wasn’t based on scientific evidence and cost them thousands and in some cases millions of dollars in lost revenues.

The restaurants that sued New York State over Governor Andrew Cuomo s restrictions under an Orange Zone classification have been given the green light to reopen. Yesterday, January 13, 2021, New York Supreme Court Judge Henry Nowak announced that the restaurants can temporarily reopen indoor dining, according to WKBW. The decision is temporary and the restaurants must follow yellow zone restrictions. Only four people will be allowed per table, both indoors and outdoors, under Yellow Zone rules. Bars and restaurants also must close indoor and outdoor dining by 10 pm, according to the rules provided by NY Forward. A decision on whether the restaurants can keep indoor dining open permanently is expected next week. Following a judge s ruling that WNY restaurant owners who filed a lawsuit against the state would be able to reopen under Yellow Zone restrictions; Erie County says they will apply the yellow zone guidelines to all Erie County restaurants.  That means all restaurants in Erie County will be able to offer indoor dining at 50% capacity and no more than four people per table. Restaurants will still have to abide by the 10 p.m. closing time.
