Enforcement discretion has long been a standard administrative agency prerogative. Recently, the practice of agency nonenforcement took the stage as nine states and some nongovernmental organizations brought lawsuits against the U.S. Environmental Protection Agencyâs (EPA) temporary enforcement policy published amid the COVID-19 pandemic.
