N.J. town can’t block medical weed growing facility, court rules Updated Mar 04, 2021; A state court has overridden a town’s decision to block a medical weed growing facility months after construction had begun at a former orchid greenhouse. The state Superior Court in Gloucester County ruled in favor of High Street Capital Partners, which does business as Acreage Holdings, finding that Mantua Township was wrong to wait months to deny a zoning permit to grow cannabis and wrong to say no simply because it is a marijuana facility. Towns can bar cannabis businesses, but must pass ordinances to do so. Municipalities have six months to decide if they want to block the growing, manufacturing and distribution of weed under the new legalization law signed by Gov. Phil Murphy last week.

Phil Murphy is expected to sign two bills before New Year’s Day that will give birth to a new recreational marijuana industry in the Garden State and decriminalize the possession of up to 6 ounces of cannabis. The bills, which received strong bipartisan support in the state Assembly and Senate, will initially create 37 licenses for firms that can both grow weed and sell it.
