Unanimous vote to sentence someone to death. But in florida, the judge was able to decide on the Death Penalty for hurst. He brought it to the Supreme Court who ruled that it is not constitutional. The judge cannot change it. Reporter now juries will be more empowered to decide the maximum penalty, not judges. But that could also affect 400 florida inmates currently on death row, creating a potential mess in our courts. There will be a number of people where the sentences will have to be reheard. Reporter the state will have to go through every case and decide which ones to retry and which ones to commute. There will be inmates challenging their own death sentence. But Steven Crawford thinks its necessary. We want a jury to make the decision, not an elected or appointed judge.
