we begin this hour with a slew of legal setbacks for former president trump including the new orders by the special master he requested. let s go right to our justice correspondent jessica schneider. the special master is call out the public claim that the fbi planted evidence at mar-a-lago. he is, wolf. now that special master wants trump s teams to back up those out of court claims that the fbi planted evidence at mar-a-lago and he wants it in a sworn declaration by the end of this month. it s an accusation that trump and his allies have repeatedly made and now the special master wants proof plus the special master is saying he may end up calling witnesses at some point to explain what certain documents are if there s a dispute. all of this as the justice department notched a big win in the ongoing court fight over classified documents. the justice department is once again digging into 100 classified documents that fbi agents seized from mar-a-lago. i think they want to
rejects its bid to exclude about 100 documents marked as classified from the special master s review. it seems like this is getting really complicated. reporter: yeah, jake. the lawyer for the government saying that, if they lose that appeal, they will likely appeal this even further. so, again, up to the supreme court. they said that could then complicate the timeline around the turning over and the sharing of the classified documents. so certainly something that could become a not knotty issue as they try to expedite this review of documents and ultimately get to the heart of this investigation. jake. kara scannell in new york, thank you. let s discuss with former assistant attorney general tom duprey and john miller from the new york police department, now workings for cnn. john, welcome to cnn. good to have you. you can connections with many in the intelligence community. how are they responding to all of this? this is making them quite nervous. the ruling by judg
moral win for garland s approach. he s very modest. they took a very sharp scaled back approach. they didn t engage in hyperbole. they didn t engage in a full frontal attack and it certainly did not work with judge cannon, but with these appellate judges, garr lapped himself, former appeals judge, the judge s judge talking to them and that approach seems to have worked very well and resonated with the circuit. you know, john miller, we all just heard the former president of the united states claim he could declassify top secret documents simply by thinking about it, his quote, by thinking about it. that s not how the declassification process clearly works, is it? no. as a former deputy assistant director of national intelligence where, you know, we looked at classifications, categories, where we looked over an army of classification officers who examined every document for how it should be
it s always interesting to talk to somebody who was in the same area at the same time. especially someone who suffered injuries. that s what i was doing when i was there, crewing medevac helicopters. definitely for guys like that that have been through a lot, i have a soft spot for. try to help him out best as i can. a short time later, classification officers have found a new housing assignment for sobel. we have an area for individuals who don t need protective custody. but might not have as much experience with criminals and the criminal lifestyle. based on what he said and the research we ve done, i think he would be a good fit for that spot. grab all of your stuff. okay. you can take 17. it s only got two other
