A regional state appellate court denied the motion of Rochester Mayor Lovely Warren and her two co-defendants to move the trial outside of Monroe County.
A five-judge panel from the Fourth Department Appellate Division of the state Supreme Court ruled defendants had not sufficiently demonstrated that the jury pool would be tainted here after extensive media coverage. It called the defense motion premature.
The court allowed for the potential of the trial being moved to a new area if an impartial jury cannot be seated in Monroe County.
