Eateries leery to reopen amid appeal of strip club ruling

SAN DIEGO (AP) Notorious Burger owner Brian Gruber said he felt like he was giving an early Christmas gift to his employees when he called them back to work following a California judge’s ruling that cleared the way for all restaurants in San Diego County to resume on-site dining.
He was holding his breath that the ruling would stick as California’s 4th District Court of Appeal was scheduled Friday to hear an appeal by Gov. Gavin Newsom’s office of the ruling that exempted two strip clubs and all restaurants from his stay-at-home order.

SAN DIEGO Eggs, waffles and burritos flew out of the kitchen Friday at The Old Townhouse, a 45-year-old institution in San Diego’s Ocean Beach neighbourhood that immediately resumed indoor dining when a judge cleared the way for restaurants in the state’s second-largest county to ignore Gov. Gavin Newsom’s stay-at-home orders.
“That’s a powerful statement,” owner Ted Caplaneris repeated as he plucked lines from his creased printout of Superior Court Judge Joel Wohlfeil’s ruling and read them aloud.

San Diego County has called off the enforcement of COVID restrictions for restaurants and entertainment venues after a judge ruled that two strip clubs are exempt from the county s orders.
The move comes one day after San Diego County Superior Court Judge Joel Wohlfeil ruled that Pacers International Showgirls and Cheetahs Gentlemen s Club can remain open and should be allowed to determine the extend of their COVID-19 protection measures. However, in his official ruling, Wohlfeil referred to the clubs as San Diego County businesses with restaurant services, which many have interpreted to mean the ruling applies to bars and restaurants, too.
