Underscoring the importance of due process and compliance with statutory requirements, the Jharkhand High Court, in a significant ruling, quashed criminal proceedings for non-compliance with summons.
The ordinance was promulgated by the state government after the 50th Goods and Service Tax (GST) Council meeting had fixed 28 per cent GST on gambling at casinos, horse racing and online gaming and had also decided that the tax should be levied on the face value of the bet. Subsequently, the central government had notified the amendment to the GST Act.
Vodafone Idea has received an order under the Central Goods and Services Tax Act, 2017, imposing a penalty of Rs 10.76 crore. The company, which is in disagreement with the order, plans to seek rectification and reversal of the penalty, citing the "alleged wrong transition of CENVAT credit into GST regime."
