those people will not be getting those gifts for christmas. allie rasmus. a long time argument between the city of san francisco and the 49ers has come to an end. it was an argument with millions of the dollars at steak. now the question is will this agreement help keep the 49ers from moving to santa clara. david stevenson is live now in the city with our report, david. reporter: julie, today the mayor of san francisco told us the city and the 49ers have reached a tentative truce over the run down conditions here in candle stick park including the parking lot, luxury boxes and seats. 49ers, that is san francisco. reporter: 49ers fans at san francisco s oak greenburg s bar cheered news of the agreement. keeping the team here while they clean up the park. litigation goes away, the threat goes away. reporter: in addition to the 49ers dropping a maintenance claim, the city will provide as much as $13 million in rent credits to help the team pay for repairs to seats, l

charges against one christien kafton reports tonight that judge dismissed charges against one defendant. reporter: the judge says there is sufficient evidence to proceed to trial for six of those accused of again rape of a 16-year-old girl. the next up is for our office to review and determine what charges we may file information with fewer chargers or we may add charges. reporter: the judge ruled there is not enough evidence to tie the youngest of the accused was just 16 years old . his family reacted with joy. i feel good, but i feel angry because they wasted 12 months of my son s life. reporter: prosecutors may seek to refile charges but already prosecutors say they have their hands full. three of the men face rape and speaker charges and two more face enhance sexual assault charges and gang rape charges. they say that at times the prosecution is contradictory. they say that one of the man accused was not involved in the gang rape but would face a sexual as
