suspect goes before a judge soon.]b?kz robert lewis dear will appear in just over an hour. he s accused of killing three people including a 35-year-old mother of two, a 29-year-old iraq war veteran and a 44-year-old police officer. will carr is live for us in colorado springs with the latest today. will, what can we expect? what will happen in court today? reporter: well, gretchen, this will be the first time that we ve seen robert lewis dear since he was arrested on friday. ñ court appearance. ñ court we ll find out if he does have legal counsel when he appears in the courthouse behind me. elhe ll will be appearing by video. we ve heard the search and arrest warrants have been sealed in this case. also, so far prosecutors have not announced the formal charges against dear, most likely because they re deciding if this will be a capital murder case. if they re going to decide to go for the death penalty after authorities say that he stormed the planned parenthood here in
all of these guys could easily be convicted of a capital murder case. the only caveat i see is if they try to flip a witness. police have what s called the open unsolved unit. hundreds of cases they haven t solved. if they can flip one of the witnesses and he can tell them of the myriad of crimes that hee able to save his own life and testify against the others. reporter: obviously they are putting pressure on all of these guys to do that. they put him in what s called the box, the interrogation room. and they sit and stew and start thinking about what trouble they are in. and police come in. video recorder through a glass window. and they start taking statements. and that s oftentimes how they are able to put pressure on people to tell the truth.
are communicating by someone, if not by cell phone or computer, they re hiding out with someone. not saying that is the case. sometimes it is. that individual may be in serious trouble as well. jon: this is capital murder case. we re talking about the potential death penalty in texas. texas is one of those states that doesn t show any compunction using the death penalty or applying it. the other two who have been arrested already, they can try to cut some kind of a deal with prosecutors in return for information about her. i believe this is why the police officers in charge of this investigation have told her, turn yourself in because if you turn yourself in, maybe, just maybe, we ll make a deal. that deal would be no death penalty. jon: and that is probably the best thing she has going for her at this point, turning herself in, is probably the best way to try to save her own life. it is only thing she has, jon. the problem some people may run into, if she communicates with
