A former Tulare Cemetery employee may sue the district after filing a legal claim alleging that he was retaliated against for acting as a whistleblower.
Brian Viera, a 13-year cemetery employee, was fired on March 8, the same day he says he refused to comply with an order to dig up human remains at a burial plot without the family s consent.
He is now seeking more than $10,000 in damages, though a specific amount was not included in the claim.
On March 8, Viera was ordered to disinter the remains of Silvano Martinez. He said he was approached by members of the Martinez family and a Univision 21 news reporter, who told the groundskeeper that the cemetery did not have permission to remove the remains.
