Former employee says CONSOL Energy violated ERISA

geralt/Pixabay CHARLESTON A man is suing CONSOL Energy for violations of the Employee Retirement Income Security Act of 1974 (ERISA). Consolidation Coal Co. was also named as a defendant in the suit. Edmond Stephenson worked for CONSOL for many years and was laid off in 2013. He was informed that if he went to work elsewhere and later wanted to activate his retiree welfare benefits with CONSOL he would remain able to do so at any time in the future, according to a complaint filed in U.S. District Court for the Southern District of West Virginia. Stephenson claims he worked for Logan Corp. from 2014 until 2015 when he was laid off from Logan Corp. He then called CONSOL to request activation of his retirement and enroll in the Retiree Welfare Plan, he was informed if he paid premiums he could reactivate the plan, which he did.

Non-union retirees sue Cabell Huntington Hospital over termination of benefits

HUNTINGTON Two retired employees say that Cabell Huntington Hospital has violated the Employee Retirement Income Security Act of 1974 by misrepresenting its lifetime retiree health and welfare benefits. Martha Marty Blenko and Laura Mullarky filed the class-action lawsuit alleging that CHH repeatedly represented to them they could retire as non-union employees beginning at age 62 and retain their health insurance if they had attained 17 years of credited service, according to a complaint filed May 25 in U.S. District Court for the Southern District of West Virginia. Cabell further informed the plaintiffs Cabell would provide comparable health insurance to the non-union retirees until they became Medicare-eligible, and that Cabell would then provide a comparable, cost-free Medicare supplement throughout the rest of those retirees’ lives, the complaint states.

Man accuses Todd Judy Ford of misrepresentation

Adobe Stock CHARLESTON A Logan County man is suing a car dealership alleging that it misrepresented a vehicle to him and failed to provide him the opportunity to review important documents. Transportation Network III LLC and Santander Consumer USA were named as defendants in the suit. Transportation is doing business as Todd Judy Ford East. Leslie Adkins was referred to Donny Pitts with Todd Judy regarding auto financing in 2018. Pitts was told Adkins and his wife could not afford a payment over $300 per month, according to a complaint filed in Kanawha Circuit Court. Adkins claims they eventually decided on a 2014 Toyota Rav 4 and were told they would need to provide a $1,000 down and that the monthly payment would be around $380, however, they later discovered the monthly payment would be $468.24. He also later discovered the $1,000 down payment he provided was not fully placed on the vehicle.
