In doing so, the Supreme Court also observed "irretrievable breakdown of marriage" cannot be viewed as a straightjacket formula to always grant divorce.
The Delhi High Court explained that the power to grant divorce on the ground of irretrievable breakdown of marriage is only vested in the Supreme Court, and not with High Courts, let alone family courts.
The Court said that many times, marriages do not work because of incompatibility and because of fault theory, parties end up fighting with each other for years.
Preservation of an unworkable marriage which has long ceased to be effective is bound to be a source of greater misery for the parties, the Court held.
