Businesses getting $12 million from polar vortex settlement

Ohio businesses are getting a $12 million refund of sorts from the so-called polar vortex settlement that resulted from a lawsuit against former FirstEnergy Corp. subsidiary FirstEnergy Solutions (FES), according to advocates for businesses affected by the case.
The issue stems from the 2014 polar vortex that plunged Ohio and other parts of the nation into a deep freeze, which resulted in FES adding a surcharge to the businesses bills to cover what FES said were increased costs for power during the weather phenomenon.
Businesses and their advocates including Chagrin Falls-based Brakey Energy, a consultant to big power users filed a class-action suit that claimed the surcharges violated the fixed-rate contracts many businesses had in place to purchase power.
