here that, in at least the criminal context, that the statute of limitations is being longer in many, many states. and because of that, prosecutors will have the ability to bring cases. however, having been an attorney who has tried rape cases, i can tell you that even when they re timely, they re very, very difficult cases. so the idea of having cases that are ten or 20 or 30 years old, you re really having a hard task as a prosecutor. very difficult cases. so if criminal charges don t happen or can t happen in some of these cases, what about the possibility of civil charges? do you expect we ll see more of that with the cases that are already out there? unfortunately, one of the problems with the civil cases is that we have confidentiality agreements and gag orders that keep women, if they do take a settlement, through mediation or arbitration, or even binding arbitration, that keep them silent. and unfortunately, that s a public safety issue, because even in cases of sexual hara
sexual harassment cases. somebody with a complaint has to file the complaint, they then have to go through mandatory counseling for 30 days and then this binding arbitration for 30 day. and if they don t like it, their only recourse is to go to court. so the first thing that has to happen is the office of compliance has to be made much more transparent including the money that s paid for settlements. but secondly the office of compliance has to be linked to the ethics committee. right now the office of compliance could find that a member of congress engaged in any kind of discrimination, including harassment. and that would not have to be reported to the ethics committee. so there neds to beeds to be a there. and finally people have to have the ability to go directly to ethics committee. and we need to bolster up the ethics of the ethics committee and we also need to stream line
hypocrit hypocrites. but hollywood, they have a hard time shining a light on the wrong things that they do. you ve heard a lot of actresses say i don t want to comment because i m so angry and i don t want to be misquoted. at the end of the day there s no side to be on there. there s no wrong way to say anything. exactly. you could even take a bad thing and turn it into something positive. when sexual harassment cases started being covered from insurance companies, what you saw was a lot of policies against sexual harassment, which was fantastic. unfortunately the problem is now it s part of the employee handbook and they have binding arbitration, which again is keeping women quiet. so maybe we just need to have different cycles of exposing sexual harassment to keep on evolving and going forward and exposing it. could louis ck see more legal repercussions because he has admitted to doing in fact what he did. and what he did was ask women if he could actually pleasure himself in
going to take money and it s going to take real leadership from the top levels of these corporations and workplaces to say we re going to hold the most powerful men who are harassers accountable for their behavior, and then we also expect men to step up and call out that behavior when they see it and be good allies so it s not just on all of these women who have been coming forward to make known the scope of this problem. but karen, can we take it one step further and say we re going to hold these men accountable that are in these positions of power that are doing it not just when it s being reported on, but when one person comes to us and says it s happening, we re going to hold that person accountable, not because there s an expose in some major newspaper and suddenly we have to hold people accountable because we have to, and the country s looking at us. employment procedures were changed to protect men, meaning that binding arbitration in employee handbooks are meant to keep wom
