KANSAS CITY, Mo. — A stay of execution ordered Tuesday in the case of Johnny Johnson was reversed Saturday by the U.S. Court of Appeals for the Eighth Circuit.
Johnny Johnson, 45, is to be killed by the state in three days after an appeals court reversed a prior decision to stay his execution. His attorneys argue the latest decision constitutes “cruel and unusual punishment.”
Johnny Johnson, 45, was granted a stay by the U.S. Court of Appeals for the Eighth Circuit in a 2-1 decision announced July 25, which halted the Aug. 1 execution.
The 2-1 decision was announced in a one-page order issued Tuesday. The Missouri Attorney General’s Office will ask the court to vacate the stay, a spokeswoman said.
