The vehicle had to be cut apart by the Fire Department to try to render assistance to the driver and the passenger. A woman who was a passenger in the back seat of the bmw is in serious condition and so is the driver of of the pickup truck. The car that was being passed received minor damage. Attorney general eric holder made a major announcement that could change the country policy on minor drug offenses. Were live in San Francisco with more on the plan and how it will affect prison over crowding. Reporter the Justice Department says they spent over 80 billion in 2010 alone incarcerating minor drug offenders. The federal prison system is 40 over capacity. The tone general said today this would not only free up prison space and also target major drug offenders. Holder making the keynote address at the American Bar Association convention this morning in San Francisco. He announced a plan in which low level, nonvine drug offenders with affiliations to gangs or drug scale operations would not get severe prison time for manner to minimum sentences. The new plan would call for low level drug offenders to get reduced prison time or be diverted to drug treatment programs instead. car neilan way in indictment heights. here s the latest on the investigation. john? reporter: this is an unsettled sunday here in this area, which is a second cliewldded dead end street. the man s body was found behind the row of homes you see behind me. as late as 4:00 this afternoon, inspectors from the san francisco police department were poking around the brush and the hillside behind the homes. they still don t know the name of the victim who has gunshot wounds. there is a steep hill leading down to the row of town homes. the body was discovered in a concrete drainage gully. police don t know exactly how it ended up down there. one neighbor told us he heard gunshots around 11:00 last night but at the time he says it sounded lime fireworks. around 9:30 this morning another resident, who takes care of the landscaping here, found the body and called police. an hour or so ago we saw a police car drive by bit basically officers are starting from scratch, checking the victim
