Michigan appeals court OKs marijuana as medicine for probationers

Bill Laitner Detroit Free Press Michigan judges may no longer ban the use of medical marijuana by an offender on probation who is a state-registered medical marijuana user, according to the Michigan Court of Appeals. The court’s 3-0 decision last week was in a published opinion establishing a precedent that judges must now use in subsequent cases statewide. The ruling means that judges and probation officers can’t overrule the protections granted to medical marijuana users by Michigan voters in 2008, when residents approved the Michigan Medical Marihuana Act with 63% voting yes. Despite voters overwhelming approval of the law, it took 12 years for Michigan courts to fully recognize the law’s protections, said Michael Komorn, a Farmington Hills lawyer who successfully argued the appeal. LANSING, Mich. (AP) The first year of state-licensed recreational marijuana sales in Michigan saw $511 million of sales in recreational and $474 million in medical sales, generating over $100 million in tax revenue, but the state also found that the commercial marijuana industry drastically failed to attract minority business owners. The Marijuana Regulatory Agency collected data in December that showed 79% of people interested in ownership of licensed marijuana facilities were white. Black people accounted for 3.8% while 1.5% were Hispanic or Latino. In response, the agency’s Racial Equity Advisory Workgroup, comprised largely of people of color who are experts in equity programming, made recommendations that would create partnerships with large businesses and local municipalities to equip communities disproportionately impacted by marijuana being illegal until 2018.
