Sindh Child Marriage Restraining Act challenged in SHC Karachi May 2, 2021 The Sindh Child Marriage Restraining Act 2013 has been challenged in the Sindh High Court as “against the injunction of Islam and the constitution”, which cannot be applied to the Muslims. Petitioner Ali Azhar submitted that he married Arzoo Fatima after she converted to Islam on October 13, 2020, but she was not being allowed to live with him due to the Sindh Child Marriage Restraining Act 2013. He submitted that vires of the act are against the injunction of Islam and are therefore not applicable to the Muslims. He submitted that the family judge has to decide each and every issue of Muslim marriage in light of the Muslim law according to their religion. He submitted that he filed a suit in a family court for the restitution of conjugal rights, but it was dismissed by the court and the appellate court.

Court dismisses appeal of man seeking custody of his underage wife

Karachi April 23, 2021 A sessions court has dismissed the appeal filed by the man who married teenager Christian-turned-Muslim girl Arzoo seeking her custody. Ali Azhar has been through a trial for allegedly kidnapping the girl, who is said to be under the age of 15, forcibly marrying her and raping her. His two brothers, as many lawyers, a friend and a cleric have also been implicated for allegedly facilitating the offence. Azhar, who was recently released on bail, had pleaded to the court to allow him to meet his wife who is currently living in a shelter home. He said that being a single male member, he was having difficulties in taking care of his family.
