Bader Farms Argues in Answer Brief That Monsanto, BASF Knew Dicamba System Would Result in Damages

Agriculture your username 7 hours ago On Wednesday, Bader Farms Inc. filed an answer brief in its Eighth Circuit appeal against Monsanto and BASF. The plaintiffs filed the appeal after the Eastern District of Missouri reduced the initial damages awarded to Bader Farms and Bill Bader to resolve claims that herbicide dicamba ruined the plaintiffs’ peach orchard when sprayed on a neighboring field.  The $75 million judgment on Nov. 25, 2020, was reduced from the jury trial’s judgment of $265 million. The current judgment accounts for $15 million in punitive damages and $60 million in post-judgment interest.  Monsanto alleged that the $75 million was an error in its opening brief, arguing that under Missouri law it should not be liable for the damage because the actual damage was done by a third-party farmer using Monsanto and BASF’s Xtend crop system, which was resistant to dicamba herbicides.

The Voice of the Defense Bar and Washington Legal Foundation; the American Seed Trade Association Incorporated and CropLife America; Product Liability Advisory Council Incorporated; and Chamber of Commerce of the United States of America, Coalition for Litigation Justice Inc., Missouri Agribusiness Association, Missouri Chamber of Commerce and Industry, and National Association of Manufacturers submitted briefs in support of the appellants.

Monsanto Claims $75 Million Judgment Expanded Missouri Law in Eighth Circuit Brief

Agriculture your username 5 days ago Monsanto filed its opening brief in an Eighth Circuit appeal of the $75 million judgment in a dispute over harm allegedly caused by dicamba herbicides to peach trees owned by the plaintiffs, Bader Farms and Bill Bader. The brief and its addendum were submitted for review by Monsanto on Friday and were filed in the case on Monday.  Monsanto argued in the brief that the District Court had erred by “massively expanding Missouri’s doctrine of proximate causation” in its ruling and that the company should not be liable for the damage because it did not manufacture or sell the herbicide, which purportedly caused damage to the seeds. 

Bader Farms Appeals $75M Judgment in Peach Tree Dicamba Dispute

Agriculture your username December 23, 2020 Bader Farms appealed a judgment in its lawsuit against BASF and Monsanto to the Eighth Circuit. The two separate lawsuits were docketed on Tuesday. The company is asking the court to rule in its favor and grant the plaintiffs the original judgment rather than the reduced judgment, one-third of the original amount.  The matter was transferred to the District Court in late 2016, and was being heard in the Eastern District of Missouri for about four years. The plaintiff purported that its peach trees were irreparably damaged because herbicide with dicamba was used on nearby crops, designed to be resistant to dicamba herbicides, but spread to the peach trees causing damage.
