Court awards N50million against EFCC for re-arresting defendant
The judge, says there is no legal basis to rearrest a defendant who has been granted bail.
The Federal High Court in Abuja on Tuesday awarded N50million damages against the Economic and Financial Crimes Commission (EFCC) in favour of a defendant, Babatunde Morakinyo, who was unlawfully re-arrested by the commission’s operatives last year.
The judge, Inyang Ekwo, ruled that the anti-graft agency abused its powers by re-arresting Mr Morakinyo after he was granted bail by another judge of the court, Ahmed Mohammed, on March 19, 2020.
Mr Ekwo ordered the commission to publish a public apology to Mr Morakinyo in two national dailies within 14 days for trampling on his rights when he was re-arrested on the court premises in Abuja shortly after he was released on bail.

A Federal High Court sitting in Abuja, on Monday, ordered the Economic and Financial Crimes Commission (EFCC) to pay the sum of N50million to a businessman, Babatunde Morakinyo and publicly apologise to him for unlawful arrest and detention.
The trial judge, Justice Inyang Ekwo gave the orders while ruling on a fundamental rights enforcement suit, marked: FHC/ABJ/CS/437/2020 by Morakinyo against the EFCC as the sole respondent.
Justice Ekwo declared as unlawful and a breach of Morakinyo’s rights to personal liberty and dignity his arrest on March 19, 2020, within the premises of the Federal High Court by officials of the anti-graft agency.
