A group of Australian children have hailed a “global first” Federal Court decision, which acknowledged the government owes them a duty of care when considering projects which may accelerate climate change.
Federal Court Justice Mordecai Bromberg did not grant the students’ proposed injunction on a NSW coal mine expansion, but acknowledged Environment Minister Sussan Ley owes future generations a duty of care.
The ruling is a “giant leap forward in climate litigation in Australia,” said lawyer David Barnden, who represented the children.
