Well, the judge said that the test for the constitutionality of any abortion law is the same one that the Supreme Court has consistently applied for 40 years. And that is whether it would ban abortions after viability. What the judge said is, its medically, generally conceded that viability is 24 weeks into pregnancy. This law would have banned abortions at six weeks, roughly, into pregnancy. He said thats well beyond the bounds of constitutionality. The judge in his opinion said that nearly 90 of the abortions that are performed at the only Abortion Clinic in south dakota would be banned by this law and that he said would mean the clinic would also probably have to close its doors it because it just wouldnt have enough revenue to continue to operate.
