appear before a grand jury. on the phone, he was a little bit more measured. he said ultimately i m going to cooperate with them. i just don t want to make it easy and i don t think it s fair that i ve got to go through all my e-mails and send them to him. it s going he s going to sit. i mean, i don t think the guy wants to go to jail. then walk me through this though. it s too taxing on sam, ari, to go through loads of e-mails but he s willing to sit through a grand jury. he s willing to go to jail. that s no biggie. this is not significant because of what sam nunberg says about what he will or won t do. i think it s obvious he s not sure what he s doing. this is significant because it s the first on the record leak and disclosure about the people that are of the most interest to the special counsel probe, that list of ten names. it s also significant because he s detailed on the record more than any other witness what he was asked about which give us some clues to the line of q
significant. he s probably going to testify. i suspect the most significant thing we re going to find out, if you look through all his interviews yesterday, is his concern about somehow giving evidence against roger stone. that was really the one thing that stood out to me. came back over and over again. he was worried about setting up roger stone. two things. roger stone, which he was very emphatic about. number two, i think we can play this sound, he also disclosed in the interview to me that he is under the impression through his lawyer he was offered immunity, which is new and relevant information. we have that. let s actually share it. what they did tell me was i wasn t going to be a subject or target and i was going to get the same kind of immunity. but they wanted something. now, ari, let me just say something they offered you immunity? yes. ari? it is significant, if true, that he has, from his lawyers, an immunity offer. i asked whether it was to him or his law
by evening, there was questions about why nunberg opted for such a public display. talking to you, i have smelled alcohol on your breath. well, i ve not had a drink. you haven t had a drink, so that s not true? no. nunberg repeatedly held off the possibility of being held in contempt and facing jail time. listen to what he told ari. you keep saying you don t think they ll be a consequence. what if the consequence of that is going to jail, sam? they re not going to send me to jail. if he wants to send me to jail, he can send me to jail and then i ll laugh about it and i ll make a bigger spectacle than i am on your tv show right now. i have no problem going to the grand jury. but i, once again, don t want to have to spend 80 hours going after e-mails. you d rather spend possibly a year in jail than 80 hours i m not going to jail. you think i m going to jail? i don t know. i ve never been to jail.
kind of buried off to the side and not considered a big deal, then maybe it starts to play into the greater investigation. certainly the oversight committee chairman does seem to be deferring this in part at least to the intelligence committee. he said it was really unlikely that, despite democrats demands that the oversight committee would actually pull flynn to testify before them because the intelligence committee is already handling these matters generally speaking, so i think it depends on what flynn says happened around those earnings that he made, that income that he claimed, or that he made but did not claim, and whether that was a concern to trump and his higher subordinates. malcolm, you ve been covering this closely. how do you see this fitting in? there s a big difference between the two documents we might be talking about. ari made a good point about the u.s. code 18-1001 where you have to declare your assets, resources and any contacts
from nbc s kasie hunt, kristen welker and chief legal correspondent ari melbur. kasie, on capitol hill, we need to explain the background here. all this starts well before the election. it does, chris. at issue is the are these payments that mike flynn received from rt, the russian network with ties to the russian government, and jason chaffetz and elijah cummings wrote to the white house and other government agencies saying hey, we have a lot of concerns about this and we would like to see all of the documents related to the former nsa director s contacts with foreign officials, with any foreign governments and leading to these payments. so we saw a relatively rare joint press conference today with elijah cummings and jason chaffetz after the white house declined to provide them with documents they had asked for. i caught up with jason chaffetz
