referrals is very simple. congress has the power to do this. indeed this same january 6 committee has made four similar referrals, they were called contempt proceedings, to the justice department. now, those proceedings are in some ways different than what will happen monday. we can get into that. it s a reminder yf this matters. they did four from this committee. two of them led to indictments. one of them led to a conviction. steve ban ongoing to jail because of this and another trial awaiting. so we know they have this power. and we know that the doj will process it and make an independent decision. and we know that when congress does this, they have to make the case supported with evidence which means on monday if they say donald trump should be charged, it s not just going to be that like a tweet. it s going to be with the receipts and evidence and we know this committee has come forward with receipts before. we know that it s not just about trump.
branch of government on monday. now that idea that this congress before it ends its lawful session in january would use its power to formally say for the record for history for law and for the justice department that donald trump should be prosecuted. that idea has been leaked, suggested, intermated, and also reported with sources for days now. which is why you may have heard about it. it is one of the big reasons that monday s hearing is so newsworthy. now let me just tell what you we know. we have every indication that unprecedented act will go down on monday when the january 6th committee holds its final business meeting to vote on criminal referrals and forthcoming report. let me tell what you we do know. and what we don t know. as we try to do around here. this is a huge deal. the stakes and the tension have been rising. what we do know about these
whole evidence, the whole picture? but what is interesting here is that the reporting is saying that these referrals are going to be attached with extensive evidence. you ve got people that are on that committee, on the staff that are former prosecutors that used to do they do, yeah, used to do the same thing i used to do. and have a good feel for what evidence is necessary to prove guilt beyond a reasonable doubt. i think there is a good shot if they really get into the extensive evidence that when the department of justice looks at this and compares the evidence that they ve got against the evidence that has been gathered by the committee and maybe some evidence there that the department just doesn t know about, that that could be very significant. i think the second point you raised is about the referrals on contempt. and i think that what this
a little bit easier to charge than the seditious conspiracy even though i think there is some evidence for that. but i would say that it will be very hard to imagine there aren t referrals for criminal prosecution coming from the january 6 committee and in any event there is already an investigation going on that may get us to at least some of the counts anyway. yeah. both of you are using this plural. it s like we re in place where this is normalized. that there is at least according to the two lawyers and the members of the committee which is by far more than one crime that can be referred about president trump on monday. which is why i want to go to you first. we have a lot coming down the pike. thanks to both of you. monday is also a vote on releasing the january 6 report. i ve been writing a forward to the harper column edition to the coup conspiracy. this is coming out next week. we didn t have that before. you can go to my website. january 6 right now. you ll get my 9,000 word
they can do this for several different people. which brings me to what we don t know before i bring in our experts. we don t know the list of people. we don t know the exact charges. and we have no idea, i want to be honest with you, what exactly the supporting evident would be. we can surmise and draw on what this committee has done. so when i tell through is a vote. that means it s coming. when i tell you there is reporting that they have the votes and this committee largely worked as you may have noticed unanimously that they wouldn t just be planning all this without ever throwing the book at anyone. they have the votes to do some criminal referrals. we don t know the rest. it was about one year ago this week that the committee started laying out the evidence in the public hearings. i don t know about you. we watched them closely as we think the last key hearing on monday. a lot of the evidence that came out went beyond the dramatic moment that s we lived through, what you see on t
