This is equivalent to the Supreme Court taking on one of the most divisive issues. The second choice is sa technicality. They can rule that supporters of prop 8 are not legally entitled to defend that law. The ninth circuit tried to narrow its ruling by equating it to a romer versus evans. Reporter in that case, they stripped gays and lesbians the right to equal protection.
