evening, there s breaking news and a big victory for the biden administration, the fda and the maker but widely used abortion medication that s been taken by millions of women from more than two decades. mifepristone about an hour ago, we learned that a majority of justices on the supreme court decided in effect that the pill will remain legal no restrictions on its usage while an appeal of a lower lower court ruling moves forward that ruling by a federal judge in texas, known as an opponent of abortion, put a hold on the federal approval of the pill by the fda in 2000. and raised questions about the scientific evidence provided by the fda supporting its safety. the fifth circuit court of appeals, then froze parts of that texas judge s ruling but still left significant restrictions on this distribution prohibited pills sent by mail narrowed the window of its availability and blocked healthcare providers who are not doctors from prescribing the pills. this new ruling by the supreme cour
conservative justices voted here . all we know is justice samuel lito and justice clarence thomas were in dissent and justice samuel alito. he explained his thinking a little bit. he said that he did not think that these patients would be harmed for now , if the restrictions were left in place because the appeals process is going to continue. so what happens next is this case goes back to the fifth circuit court of appeals. it has already scheduled arguments for mid may . it will really dig into the merits of the case and issue an opinion because that court is so conservative. it is very likely then that this case is going to land back at the supreme court, and then the justices will be able to really dig into the case really look into the merits and ultimately issue of folsom opinion on their own. and arianna. i mean, this is the same chord just last summer that overturned roe v. wade in this decision basically sided with
one of the big issues for the conservative agenda is kind of whittling away at difference the agencies, so when they do, take it up, it s not certain they will, but pretty sure after the fifth circuit gets through with it, there ll be a petition for social or i probably will accept it that time is when they re really grappled with this question of whether to defer to the fda for these 20 years of saying the drug is safe or whether they re going to intercede on that point, and that s where the real issue is going to be joined about. how deferential are they going to be towards the scientists and the medical science at the fda has moved pretty rapidly rapidly for the federal court system. since that decision came from the judge in texas and the fifth circuit. does everything slowed down now, as we go through this appeals process, we should not expect things to move as quickly as they have over the last few weeks and months. that s exactly right, victor. i mean, it s been moving quickly h
