jeffrey, the nine, the nine. it elana kagan was in your book and you were writing the nine a couple years from now, how might she fit into this scenario where t the other justices? i think what s most significant about her is she s never been a judge. as i said, there hasn t been a non-judge appointed to the supreme court since william rehnquist almost 40 years ago. and i think she will bring a real practicality, some real world smarts, and is something obama wants from her. he doesn t want an ivory tower intellectual. he said he wanted to break the monopoly of appellate court judges on the court. you know, once sandra day o connor was replaced by samuel alito, all nine justices on the court, former appeal court
