Yorgen Fenech’s lawyer wants to see a copy of the tax settlement agreement reached by Daphne Caruana Galizia s family following her assassination as the the family s €5 million action for damages resumed on Thursday.
The request was made and minuted by Anna Mallia, Fenech’s lawyer in the civil proceedings filed by Peter Caruana Galizia and his sons against five men currently accused of involvement in her murder plot.
The case was filed against the business tycoon, accused as accomplice in the assassination, along with George and Alfred Degiorgio, who allegedly carried out the car bomb explosion, as well as self-confessed hitman Vincent Muscat and middleman Melvin Theuma.
Veteran lawyer Anna Mallia is challenging the recommendation by the Judicial Appointments Committee for the appointment of four new judges, claiming in court that the committee had not been validly constituted and it had “circumvented” the Constitution and acted beyond its powers.
The committee last week unanimously recommended the appointment of Magistrates Neville Camilleri and Audrey Demicoli and lawyers Christian Falzon Scerri and Ian Spiteri Bailey as judges after a public call for nominations. The recommendation was accepted by the President. 29 nominations had been received by the committee.
In proceedings before the First Hall, Civil Court in its constitutional jurisdiction, Mallia argued that that committee s recommendation should be declared null and void.

One of Yorgen Fenech’s team of lawyers has requested access to murdered journalist Daphne Caruana Galizia’s tax returns, in a compensation case filed by Caruana Galizia’s heirs.
Caruana Galizia was murdered in a 2017 car bombing. Tumas magnate Yorgen Fenech stands charged with plotting her murder, together with others.
