A Hamilton County attorney said evidence in Andrew Smith s second-degree murder case should be dismissed because Collegedale police did not read Smith his rights to an attorney and to refuse to answer questions.

On March 18, 2020, the Marion Police Department (MPD) conducted an investigation of a complaint of improper touching of a child.
According to the press release, the victim claimed that they had been inappropriately touched by 44-year-old Jason Collins, of Marion. During the interview, the victim advised that another child in the home was also touched inappropriately. The child also claimed that Collins’s girlfriend, Angela Whitt, 44, of Marion, knew that these incidents were happening.
On Jan. 5, 2021, the Department of Child Services reported to Marion Police that a second victim had disclosed to another adult they were inappropriately touched by Collins.
