A constitutional challenge by Millbrook First Nation councillor Chris Googoo, who has claimed a treaty right to sell cannabis, will not go ahead this summer after a judge ruled there was not enough evidence to show he was operating a dispensary raided by police in 2020.
While Mi'kmaw treaty rights have long been asserted in the fisheries, most prominently in the Nova Scotia lobster industry and increasingly with lucrative baby eels, cannabis is emerging as a contentious new legal and social battleground.
